Legal Wing -FBR

NEW INITIATIVES

Supreme Court Judgments/Decisions/Orders

  • Compiled in four volumes, Supreme Court Judgments/ Decisions/ Orders dispatched.
  • Certain instructions for taking necessary action issued.
  • Lists sent to the Supreme Court for fixation of appeals

Perusal of Orders-in-Original/Appeal

  • Orders-in-Original/Appeal invariably received in the Board and being perused for its legality and propriety.
  • Detecting agency directed to file an Appeal.

Expeditious Disposal of FTO Complaints:

  • Genuine FTO complaints are being locally settled.

  • Such strategy has practically helped in reducing time lag and expeditious disposal of FTO complaints.

Circulation of President’s Decisions:

  • Important issues decided by the President in favor of the department already circulated to the field formations to be quoted in future references and representations.
  • The same are being placed on FBR Website
 
 

COMPUTER NETWORKING & CONNECTIVITY

  • Direct Taxes (Appeals) Software is already operational in Islamabad (Appeals) office. The rollout of this software for other Appeals Offices is in progress.
  • Process for Indirect Taxes found similar to Direct Taxes, so same software will be used, after slight modifications. The Pilot Site is planned to be operational by 30.08.2007. The rollout of this software for other Appeals Offices is expected by 30.09.2007.
  • Computer Networking and Connectivity with all Appellate Tribunal Benches/Hqrs and with Board is planned for early disposal of cases and for other relevant matters.
  • PRAL has already done some home work on the same which is being expedited, if considered deem appropriate.

CONNECTIVITY WITH FTO OFFICE

  • A software has been developed to keep record of:
     
    • All FTO’s correspondence to and from FBR and field offices.

    • Receipt of complaints from FTO’s office, dates of hearings, filing of comments, receipt of FTO’s findings/decisions in FBR and compliance report to FTO Office.

    • Filling of review petitions to FTO and submission of representations to the President of Pakistan against findings/decisions of FTO, if any.
       

  • This programme will provide compliance wise updated status and due dates for compliance to any complaint filed with FTO.

  • The programme will cater to FBR’s needs to avoid any default/non compliance in FTO’s matters. The system is already operational.

APPEALS AND LITIGATION MANAGEMENT AND REPORTING SYSTEM

  • This high level requirements document identifies scope of software, required by FBR HRM & Administration wing to compile and manage data, related to FBR (and related field offices) employees’ appeals and litigation cases at High Courts and Supreme Court. Software will initially be installed in FBR head office. Later, it is possible to install it in different/multiple field offices.
  • In field offices, software will be used for appeals related activities and not for litigation cases. Each field office will have its own copy of software.
  • Field office software will populate central software database (at FBR head office) as per decided frequency. The rollout of this software to the field offices is expected by 30.06.2007.

DESIGNING LEGAL FRAME WORK

A similar, though not identical, legal framework has already been designed and incorporated for the enforcement and collection functions of Direct Taxes and Sales Tax by harmonizing the relevant laws of both these taxes.
 

CASE LAW SOFTWARE

The case law software already developed has been made available for every body’s consumption by using networking techniques for IT.
